Criminal Offense Analysis: "Desertion In Peace Time" Committed By TNI Soldiers In Decision No. 22-K / PM.I-02 / AD / III/2025

Desertion is one of the military crimes that can damage the discipline and integrity of military units. In the context of the TNI, desertion is expressly regulated in the Military Criminal Code (KUHPM). This study analyzes the crime of desertion in peacetime as occurred in Decision No. 22-K / PM.I-02/AD/III/2025. Through normative juridical methods with a case study approach, this paper outlines the elements of the offense of desertion, the application of the law by military judges, and the analysis of legal considerations in deciding the case. The results showed that the desertion committed by TNI soldiers in this case meets the criminal elements stipulated in Article 87 of the Criminal Code. The judge in the ruling considered the weighting aspect related to threats to military discipline but also gave mitigating consideration for the defendant's personal reasons related to family.
